Terms & Conditions
We will build all projects according to the description laid out within this proposal. Until work is paid for in full I, Natalie Power, will retain all and any rights to the art work/designs. Any additional features, pages, or other changes to project requirements may affect the time line and costs laid out within the information above, and will require a separate updated document.
I reserve the right to use any visual representation created from all final/approved projects as part of my portfolio. I will be the sole creator of the work, which will be original work and free of plagiarism. I will cooperate with the Client in the editing stage and otherwise review the work prior to completion.
Confidentiality
I acknowledge that I may receive or have access to information which relates to the Client’s past, present, or future products, vendor lists, creative works, marketing strategies, pending projects/proposals, and other proprietary information. I agree to protect the confidentiality of the Client’s proprietary information and all physical forms thereof, whether disclosed to Designer before this Agreement is signed or afterward. Unless strict confidentiality is requested by Client in advance of the establishment of this contract, I can display materials and final work created for the Client on the my website (http://nataliepowerdesigns.com).
Compensation
After client has approved the project, they will then receive the final assets. If the parameters of the Work change, or if it involves more time than estimated, I will inform the Client and they can renegotiate the Work’s cost. I am responsible for the payment of all federal, state, and/or local taxes with respect to the services I perform for the client as an independent contractor. The Client will not treat me as an employee for any purpose. The total price of this project as stated above in the proposal.
The client will be required to pay 50% up front and the remaining 50% will be required upon completion of the project. Payments may be made with Venmo, Apple Cash, or PayPal. Venmo is preferred.
Copy & Text Content
I’m not responsible for writing or editing any text copy unless specified in the original estimate. However, content and messaging is critical step when it comes to having an impact, so for that reason I do have copywriters that I collaborate with that can assist with your project. My packages do not include copywriting.
Photography
You should supply graphic files in an editable, vector digital format (.ai, .eps, .svg, or .pdf). You should supply photographs in a high resolution (300 dpi) digital format. If you choose to buy stock imagery and need suggestions I can provide a list of stock libraries. If you’d like me to search for photographs for you, I can provide a separate estimate for that as well. If you need any advice on these formats I’m always happy to help.
Client Approval
Upon acceptance of the Work, Client accepts responsibility for any further processes in which this work is used (e.g. film outpost, printing, etc.) I, Natalie Power, am not responsible for errors occurring in this work or projects related to this work after acceptance of the Work by the Client.
You must be specific with your feedback. If you are requesting revisions, it is most effective to offer examples of colors, fonts, images and sites you like. Excessive revisions, tweaks and miscellaneous changes are subject to additional charges at my discretion.
Errors in text or formatting that I have introduced into your content will be fixed for free. However, any other edits such as typo/grammatical errors/wording changes carried over from the original copy may be subject to additional charges.
I am not responsible for revisions or updates to a project once the final agreed upon deliverable has been sent. If additional design, coding, or edits associated with this project are needed, a new project agreement will be created.
NOTE: Once you approve a design, it’s considered final. Final will meant that I’m happy to make changes should you request them, but all changes will be quoted and billed separately. Be sure to proofread carefully before approving the final design.
Cancellation
Both parties understand that Client or Designer may terminate the service at any time if, for any reason, the relationship is deemed unsatisfactory by either party. Upon written or verbal cancellation, Client is responsible for payment for all expenses incurred and any work done towards the completion of the project based on the percentage of the project completed that is determined by Designer. Should the Client cancel the project following its completion, Client is responsible for full payment as per the agreed upon estimate plus all expenses incurred. In the event of cancellation, Designer retains ownership of all copyrights and original work created.
Acceptance of Terms
Client promises to pay for the services rendered by Designer for the Work as agreed upon. By signing provided contract, Client agrees they have read, understood, and are considered legally bonded to these terms.
